I. General Terms and Conditions

1 Scope

For business relationships with our customers, the following General Terms and Conditions apply to orders placed via the online shop in their version valid at the time of the order.

Customers are both consumers and businesses. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial nor their independent professional activity. A business is a natural or legal person or a legally capable partnership that, when entering into a legal transaction, acts in the course of its commercial or independent professional activity.

2 Offer and conclusion of contract

The presentation of products in our online shop does not constitute a legally binding offer, but rather a non-binding online catalog.

The subject of this contract is the sale of goods via our online shop. After entering your personal data, successfully completing each step of the order process, and clicking the corresponding button in the final step, you submit a binding offer to purchase the goods contained in your shopping cart. Before submitting your order, you have the opportunity to identify any input errors and correct and/or change them using the correction function.

Confirmation of receipt of the order follows immediately after the order is submitted. This automatic confirmation of receipt merely documents that the order has been received by us and does not constitute acceptance of the order.

We are entitled to accept your order within 5 days of receipt by sending you an order confirmation in writing or in text form (e.g. email), in which you are asked to make payment, the processing of the order or the delivery of the goods is confirmed.

By way of exception, the following applies to consumer customers: A binding contract can also be concluded earlier if you choose an online payment method and make the payment immediately after submitting the order. In this case, the contract is concluded at the point in time when the respective payment service provider confirms the execution of the payment instruction to you.

3 Payment

Only the payment methods displayed during the order process are accepted. The available payment methods and information on any additional costs associated with a payment method can be viewed in advance on the information pages of our online shop.

Delivery is made by sending the goods to the address provided by the customer.

Delivery is subject to the packaging and shipping costs displayed during the ordering process. Information regarding any delivery restrictions and applicable packaging and shipping costs can be viewed in advance on the information pages of our online shop.

Should an item become unavailable despite careful planning through no fault of our own, you will be informed by email and any payments already made will be refunded.

5 Retention of title

The delivered goods remain our property until the purchase price has been paid in full.

For business customers, the following applies differently: We retain ownership of the goods until all claims arising from the ongoing business relationship have been settled in full.

6. Liability for defects (warranty)

The statutory warranty rights apply.

For business customers, the following applies: Warranty claims due to defects in the goods expire one year after the transfer of risk. This excludes claims for damages, claims due to defects that we have fraudulently concealed, and claims arising from a guarantee that we have given for the quality of the goods. Also excluded is the right of recourse under Section 478 of the German Civil Code (BGB). The statutory limitation periods apply to these excluded claims.

7 Transport damages

For consumer customers: Please report any transport damage to the delivery driver as soon as possible and contact us. Our contact details can be found in the legal notice. Please note that failing to report damage or contact us will not affect your statutory warranty rights. However, your cooperation helps us to assert our own claims against the transport company.

For business customers: In accordance with § 377 HGB, they must inspect the goods immediately upon receipt for correctness, completeness and defects.

8 Choice of law and commercial jurisdiction

The contractual relationship between us and the business customer is governed by the laws of the Federal Republic of Germany. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.

The place of jurisdiction for all disputes arising from the contractual relationship between the customer and us is our company headquarters, provided that the customer is a merchant, a legal entity under public law or a special fund under public law.

9 Youth protection

The sale of alcohol to minors under 18 years of age is prohibited. Our products and services are exclusively for customers of legal drinking age. If you are under 18, you may not order alcoholic beverages from us. By placing your order, you confirm that you are at least 18 years old. In cases of doubt, we may request proof of age or use other suitable age verification methods (e.g., the PostIdent procedure).

All products in our range are freely available for purchase and do not require registration. Items marked "proof of age" on our website (e.g., handcuffs, batons, knives, swords, morning stars, crossbows, bows, axes, clubs, etc.) may only be sold to persons over 18 years of age. To ensure your date of birth and/or age can be verified beyond doubt, we require official proof of age (copy of your ID card/passport or driver's license) with your first order. Please set your fax to light brightness so that the proof of age is easily legible.

Acceptance of the order is expressly subject to the condition that the customer meets the requirements applicable in their country. If the customer misrepresents their age when placing an order, no contract is formed.

In cases of doubt, we request proof of age or use other suitable age verification methods (e.g., PostIdent procedure).

2 Technical steps leading to the conclusion of a contract and correction options

You can add the desired items to your virtual shopping cart without obligation. You can access your shopping cart at any time to view, correct, and/or delete its contents. If you wish to purchase the selected items, you must complete the order process by entering your personal information and selecting your preferred shipping and payment methods. You can cancel the order process at any time by closing the browser window or complete it by submitting the order. You can identify and correct any input errors in your order before submitting it using the correction functions. The contract is concluded in accordance with section 2 of our Terms and Conditions (in Part I, General Terms and Conditions).

3 Essential characteristics of the goods

4. Contract language

The language available for concluding the contract is German.

5 Delivery time information

The delivery time is stated in the respective offer in our online shop. If no information is provided there, the delivery time is a maximum of 5 days for domestic deliveries and a maximum of 10 days for international deliveries. If Sundays or public holidays fall within the delivery period, the delivery time will be extended accordingly.

7 Information on Alternative Dispute Resolution

8 Warranty

III. Right of withdrawal for consumers:

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

You must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but this is not obligatory.

To meet the cancellation deadline, it is sufficient that you send your notification of exercising your right of cancellation before the cancellation period expires.

Consequences of the revocation

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (excluding any additional costs incurred if you chose a delivery method other than our cheapest standard delivery option), without undue delay and no later than fourteen days from the day on which we received your notification of withdrawal. For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You are only liable for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing their condition, properties and functionality.

Reasons for the non-existence and premature expiry of the right of withdrawal:

The right of withdrawal does not apply to distance selling:

In the case of the delivery of goods that are not prefabricated and for whose production an individual selection or specification by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

For deliveries of goods that can spoil quickly or whose expiration date would be quickly exceeded.

For deliveries of newspapers, magazines or illustrated magazines, with the exception of subscription contracts.

In the case of the delivery of alcoholic beverages, the price of which was agreed upon at the time of the conclusion of the contract, but which can be delivered no earlier than 30 days after the conclusion of the contract and whose current value depends on fluctuations in the market over which the entrepreneur has no influence.

The right of withdrawal in distance selling expires prematurely:

In the case of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

In the case of the delivery of goods, if, after delivery, they have become inseparably mixed with other goods due to their nature.

In the case of delivery of audio or video recordings or computer software in a sealed package, if the seal has been removed after delivery.
